The crime of under-world society in China is a serious matter. The crimes of under-world society in China cause severe harms to people, societies and nations, and the whole society and humankind are highly interested in this matter. The criminal academic considers that the crimes of under-world society in China is the priority to be solved since China can not be able to avoid this matter by it's own social and historical background.
This study was to investigate the crimes of under-world society in China, which the society of China and the criminal academic consider as a serious matter. This study included the concept and characteristics of the crimes of under-world society in China, and also included the criminal policy of the China Government on it.
The under-world society a criminal group that performs the illegal criminal activity as a basis means and rules illegally over a area and work. They have their own system of management and the main-society cultural tradition. Characteristics of the under-world society include the nature of illegal rule, the nature of systematic criminal group, the nature of region and the nature of regionalism, Pursuit of economical profit without legal proper procedure, and internal rules and structure of class.
The criminal law article 294 of China definitely regulates the crimes of under-world society with the three subjects of crime; the crime of constructionㆍleadingㆍparticipation of the group of nature of the under-world society, the crime of organization on the group of under-world society, and the crime of protection and non-interference on the group of under-world society.
The criminal academic of china currently investigates the legislation and administration of justice on the crimes of under-world society. They have analysed mainly on the defaults of criminal law article 294 of China and revealed the four defaults; the nature of foresee, the nature of perfection, the nature of main point, and the nature of system.
