In this study, a contract typed open spaces conservation systems for the conservation of urban open spaces is researched, which is widely used in Japan, as a new model for conserve private open spaces effectively. In this research, presenting history of the contract typed open spaces conservation systems and its forecasting of future development are discussed in depth.
Key results of this study are as follows : first, implementing the method to conserve urban open spaces, contract typed system which was introduced followed by public systems’ open spaces and zoning system’s open spaces is a new method since it brought a contract into a concept of the method to conserve private open spaces. This contract typed system has a buffering role between public systems’ open spaces and zoning system’s open spaces, and it is also complementary to the both methods. The contract typed system is a very useful alternative to overcome the limit of the zoning system caused by land owner’s unwillingness to conserve the urban open spaces even if the zoning systems has played a major role in conserving urban open spaces.
Second, urban open spaces conserved by a contract typed systems could be distinguished into two types: urban open spaces conserved by regulations and by law. In former case, “citizen’s forest” which introduced in 1972 is a good example. In later case, “public open spaces” which was systemized when amending “urban open spaces conservation law” in 1995. Two systems are similar in the aspect that they are based on a contract. However, it is easy to find that there are some differences in the content of the contract. Especially, “citizen’s forest” doesn’t deal with inheritance tax. In contrary to this, “public open spaces” is appraised as a more advanced system since it includes inheritance tax deduction even if its deduction level is not enough, yet.
Third, it is expected that “citizen’s forest” will be replaced by “public open spaces” gradually in the near future. Looking into the case of “NERIMA ward” of Tokyo, it is easy to find out the trend is spreading overwhelmingly. This trend is caused since it is not only governed by law, but also provides much more benefits including inheritance tax deduction.
