With the rapid expansion of business activities and the scope of commercial transactions, it is common to see a wide use of bills and checks as means of a payment in modern society. A forged signature on an instrument does not impose any liability on the person whose signature was forged. However, if he consents to be bound by the forged signature or represents that it is his own, he is liable as if he had signed the instrument himself. With the modern expansion of the use of checks and bills, individuals' credit limits are becoming exceedingly great.
Forgery is the creation of a false written document or the alteration of a genuine one, with the intent to defraud.
The Bills Act inadequately deals with the problem of forgeries of bills because it has only a single article covering the validity of obligations.
New payment systems such as Credit cards and Electronic fund transfers system have been widely used, but Bills have their own sphere. Therefore, the purpose of this study is to analyze and examine the theories and cases regarding the liability of the forgee and forger of bills, and to propose guidance for legislative and constructive solutions regarding the forgery of bills. Due to the negotiability of a forged bill, there arises a dispute between the holder in due course of bill and a principal, regarding who is liable.
When a signature is forged or made without the authority of the person whose signature it purports to be, it is wholly inoperative, and there is no right to retain the instrument. In this paper, I have explained the liability of a principal i.e. the one whose name is signed, law should protect the holder in due course.
If anyones name is forged, he is liable to no one in principle. If he confirms the forgery, he is responsible for the forgery under the Korean Civil Code article 756 or article 126 and he is liable. The purpose of this thesis is to research the liability of forged bills.
