Amidst an ever-increasing number of court cases involving e-Cornmerce, the nation has been faced with a slew of legal problems that are being proved difficult to manage under the existing justice system. In particular, the issue of how to control legal disputes concerning losses incurred by consumers is emerging as a crucial point of controversy. The Law for Consumer Protection in e-Cornmerce' went into effect in July 2002. However, consumers are finding it hard to understand what each provision of the Law stipulates due to its complicated terminology and specialized language. It has also been pointed out that the Law contains more than a few problems in respect to its legal structure. The amendment bill for the Law, which is expected to pass through the National Assembly this year, fails to supplement the existing document in a fundamental way.
This study provides an overview to the Law's major components, and investigates the legal problems raised concerning its functional use. The present text also proposes to suggest a number of remedies for those sections not reflected in the said amendment bill. A focus is placed on the following points and methods for their improvement: 1) Whether e-Cornmerce can be included in the concept of mail-order' under existing laws, and how to adopt it into the relevant terminology; 2) What legal effects are made when a consumer commits a operation error in the process of conveying his or her intention for subscription via the Internet; 3) How to protect non-adults or special classes of people in regard to various requirements for identification or potentially harmful ads, and 4) Proper period and legal effects of unconditional cooling-off of subscriptions.
