The size of public works increases with proportion to urbanization. With relation to this trend the acquisition of land for public use encroaches the living space of native dwellers. This thesis fouses on whether the current compensation is appropriate or not, especilly, in light of the section 23-3 of the Constitution. The scope of this study confines to the Burimdong of Gwacheon city, what is called the planned immigrants site, in geography. The conclusion of this case study says that the current compensation institutes are implementing improper to the justical compensation crieria described by the Constitution. In this respect the current compensation system must be improved with considering the compensation to a living right for protection of private substances as well as an asset right compensation of cash compensation.
