The rapid economic development after industrialization has caused various city problems such as housing issues, traffic congestion, air pollution, etc. In addition, the desire for a higher quality of life is increasing due to increased income and improvement of living standards. In order to solve these problems and manage them efficiently, smart cities that integrate information and communication technology (ICT) and city construction have been expanded nationwide.
In the U-City law, infrastructure, information communication networks, and integrated operation centers are proposed as components of ubiquitous city infrastructure and many studies suggest the need for efficient operation and management of ubiquitous city infrastructure. However, often times, there are many intelligent facilities where interpretation differs from the contents defined in the law. In those cases, the facilities such as roads, parking lots, and parks are intelligent facilities, but unit technologies or devices are defined as intelligent facilities to be used. Since those devices are on-site facilities that are directly installed in the city area, standards for consideration, management, and operation of the city are essential. However, the current legal system is subject to legal standards for each purpose and the local government, requires revision and supplementation.
The purpose of this study is, first, to organize the legal system related to smart cities to establish the macro direction of intelligent facilities, and to determine the hierarchy of administrative regulation. Second is to propose the definition of intelligent facilities by understanding the constitutional principles, contents, and formal properties of the intelligent facilities classified as site facilities regarding ubiquitous city infrastructure. Third is to derive the criteria and details for the installation, management, and operation of the intelligent facilities and find out the facility management history to provide a joint use plan of the intelligent facilities.
Therefore, the legal systematic issues were identified and a new definition of intelligent facilities was established in the ubiquitous urban infrastructure as well as clarifying the classification system for management by analyzing the installation and operation systems in order to prepare the administrative regulations related to the intelligent facilities. Also, a checklist was used to enable the joint use of the installation location and the collected data to confirm the purpose, duplication, and safety of the device to be installed. In addition, the joint use and integrated management of the intelligent facilities is essential, but there is no legal basis for the joint use of the multiple agencies. Therefore, it is necessary to create an intelligence facility log to confirm the purpose of use, data, and changes for each facility. This would provide a basis for the joint use of the intelligence facilities installed in other departments.
Smart cities were introduced in Korea faster than other advanced countries putting it in a leading position in the world. This study provides provisions of legal basis for intelligent facilities and proposes considerations for joint installation and use. If these are supplemented, it would be possible to strengthen the shortcomings of the current U-City Act of Smart City Law in future revisions. By organizing this law, an optimized budget reduction and operation range are expected through identifying the installation and operation history of existing and newly installed facilities and establishing standards for new installations and the joint use of intelligent facilities.
