The last several decades of economic assistance to developing countries has shown that such assistance cannot be successful without good governance in the recipient states. The most important component of good governance is the rule of law. In this regard, donor countries have emphasized the importance of the rule of law and legal reform aid, and has provided assistance in these areas to aid recipients. In particular, the transition of economies of former socialist countries and newly independent countries to market-based systems has reinforced this importance. The most active countries leading initiatives in the area of legal technical aid are the U.S., Japan, and Germany. This article introduces and examines these three countries' aid to developing nations. Of the keenest interest to these donor countries has been how to enhance and improve the rule of law which facilitates market-based economics and democratic governance. These three countries have unique characteristics related to their own policies, the volume of aid they provide, and the legal assets they possess. The United States has been pioneer and has played the most important role in this area on the global level. Japan has payed more attention to this area in the Asian region. Germany has been also very active in providing legal aid thanks to its unique experience of unification and continental legal tradition. As Korea has increased the volume of ODA it provides and has expanded its global influence through economic and political development, we Koreans need to look at the activities of major donor countries and learn lessons from their experiences. In particular, in consideration of the future transition of the North Korean system to a market economy, this issue should be examined with more care.
