An advance directive is a kind of care to make medical decision if a patient becomes unable to do it. In many legal systems, the directive involves drafting a durable power of attorney, which allows simply an agent to act for an individual in the event of incompetence. Questions are mainly on validity of the advance directive, legal meaning of death, and applicability of it to each society. Ministry of Health and Family of Korea prepares its draft on advance directive. However it may arise crucial debates in many ways. The key factor in considering whether we legalize this advance directive or not is an assessment of the benefits and burdens of medical treatment. Moreover, the constitutionality of the range of self-determination in this issue can be considered to finalize it.
