This paper aims to explain to the historical significance of a controversy on the essence of the law between Minobe Tatukichi and Yokota Kisaburo. This article approaches essence of the thought of the wartime period by analyzing it. Three points will be demonstrated throughout my analysis.(1)In the early 1930s, Minobe and Yokota debated about the essence of the law, but their opposition decided the stance of both opposition decided the stance of both for “the situation”; (2)In the wartime period, Paradoxically Minobe’s theory became a premise to bring about ”Greater East Asian Co-Prosperity Sphere” idea beyond his own intention;(3)Minobe's theory gave a theoretical foundation to the thought in the wartime.
