The great increase in the importance of logistics in the modern world has made national boundaries no longer meaningful. It became really important for the survival that logistics companies must have excellent competitiveness in the global logistics market as well as in the domestic logistics market.
Comparing Korea"s logistics companies with overseas large global logistics companies, such as DHL, UPS, FedEx, DB Sehenker, Korean companies face many difficulties in the global and domestic markets due to the lack of logistics capacity, for example, their sizes and types of the services.
Although various types of research are being conducted to address the difficulties above and to improve the international competitiveness of Korean logistics companies, most research is focused on limited areas, such as business administration and logistics. In fact, in order to develop Korean logistics companies, the management development of each logistics company is important, but it is also important that the legal and policy backup is supported for them.
For the legal support for the development of logistics companies, the first thing to do is to define the legal status of logistics and logistics companies in the law. However, the Korean Commercial Code does not define the logistics industry although logistics is one of the important commercial activities in modern society, and it makes the logistics company subject to various kinds of individual regulations, not a uniform set of business rules for logistics. And this makes it difficult for logistics companies to do their businesses.
Logistics also divides logistics companies into 1PL, 2PL, 3PL, and 4PL based on the relationship with shipper companies and the range of services offered, and it also provides the methods for growth and management strategies for each logistics company. However, legal support for logistics companies under the Framework Act on Logistics Policies is being made uniformly without considering the above characteristics.
Therefore, this paper will conduct a legal review to legally support the definition and management strategy for logistics companies from the perspective of logistics and business administration. And through this, this study will attempt to find a way to improve the international competitiveness of Korean logistics companies.
