Poor water quality will create intense pressure on usable water supplies around the world. Congress passed NEPA in 1970 in response to a need to protect a healthy environment. The concept of reserved rights springs from foundational principles of inherent sovereignty. Reserved rights refer to sovereignty, power, or rights retained by tribes during their dealings with the federal government. The trust doctrine is the mechanism by which federal obligations to Indian tribes are judicially enforced. The public trust doctrine can limit the exercise of water rights. The CWA has been used as an effective tool in cleaning. An NPDES permit is required whenever a pollutant is discharged. The TMDL is the maximum amount of a particular pollutant that can be discharged into a water body without violating the water quality standard. The legal relationship of tribes to the states has been unclear from the very beginning of the republic. Native American tribes should take advantage of recent trends in environmental law to pursue claims for damages to their natural resources and their well-being. In 1987, Congress authorized EPA to "treat an Indian tribe as a state" (TAS) for certain CWA programs. Specifically, the EPA interpreted the amendment as allowing tribes to establish more stringent water quality standards than those imposed by states or the federal government. Tribal courts generally retain jurisdiction over a civil suit by any party, Indian or non-Indian, against an Indian defendant for a claim arising on the reservation. The EPA also addressed the issue of resolving disputes between tribes and states over water quality standards.
