Indemnity insurance section in Korean Commercial Act has been enacted since January 1 1963, and Korean Insurance Academic Society has published Korean Insurance Journal since 1964. 50 years history of KAIS has walked side by side with Korean Insurance Act. This paper reviews legal articles on indemnity insurance, they consist of 16 articles on general principle of indemnity insurance, 11 articles on fire insurance, 24 articles on liability insurance, 20 articles on automobile insurance, 7 articles on other indemnity insurance, total amounts to 79 articles. In writing this review, the author has made an effort to studying each thesis in view of modern indemnity insurance practice and theory. The writer took the idea from famous historian E. H. Carr who expressed the history as the conversation of the past and present. Specific subject such as insurable interest has attracted many researchers during 50 years, but the subject such as fire insurance was studied only 1960~1970 when the fire insurance played a large portion in indemnity insurance industry. The writer was much impressed by the fact that 31% articles on liability insurance and 25% articles on automobile insurance. It explains that Korean insurance researchers are much interested in the new subject incurred by the industrialization. After the 80 articles on indemnity insurance, the writer thinks that the development of Korean indemnity insurance industry has made a lots of debts to insurance researchers. The author anticipates plenty of excellent articles in the future.

상법 손해보험편이 시행된 것은 1963년이고, 보험학회지 1집이 간행된 것은 1964년으로 보험학회지 50년의 역사는 상법 손해보험편의 역사와 같다. 이 글에서는 손해보험분야에서 법률적 관점에서 고찰한 논문으로서 손해보험통칙 16편, 화재보험 11편, 책임보험 24편, 자동차보험 20편, 기타 손해보험 7편, 제3보험 1편 총 79편을 리뷰하였다. 지난 50년간 손해보험법은 커다란 발전을 거듭하여 오늘에 이르렀다. 현대 손해보험법은 세계적으로는 영국, 독일, 프랑스의 보험계약법을 통합한 통일모델법의 형식을 취한 2009년 유럽보험계약법 준칙의 공간을 위시하여 중과실로 인한 보험사고에 all or nothing 원칙 대신 비율적 보상원칙의 채용․수동적 고지의무로의 전환 등을 채택한 2008년 개정의 독일보험계약법, 상법 시행 110년만에 수동적 고지의무 제도를 채용하고 손해보험․생명보험․상해질병정액보험의 3가지로 구분한 일본보험법, 2009년 보험법개정으로 수동적 고지의무로의 전환․설명의무를 다하지 않은 약관조항의 무효를 규정한 중국 등에서 커다란 개혁이 행해졌다. 국내적으로는 보험학회지 창간해인 1964년에는 순위를 논하기에도 초라한 규모에서 2012년 손해보험 수입료가 68.5조로 2011년 기준으로 세계 8위로, 종목별구성도 자동차보험 12.8%, 장기손보 40.2%, 화재보험 0.48%로, 1963년 화재보험이 65.1%, 해상보험 22.7%, 자동차보험 10.5%, 장기보험은 전무이었던 것에 비하여 크게 변화했다. 이 글을 기술하는 데 있어서 체제는 손해보험 통칙, 화재보험, 책임보험(일반론․각론), 자동차보험, 기타보험(항공보험, 보증보험, 원자력보험), 제3보험의 순서로 하였다. 나아가 역사란 현재와 과거의 대화라고 한 카(E. H. Carr)의 견해에서 착안하여 오늘의 손해보험법의 견지에서 개별논문을 조망하려고 하였다. 리뷰한 결과 피보험이익과 같이 손해보험의 본질적인 쟁점에 대해서는 초기에서 근래에 이르기까지 계속적으로 관심을 끄는 주제도 있고, 화재보험분야와 같이 1960년대에는 50%를 상회하던 시절에 다수의 논문이 발표되었지만 근래에는 점유율의 쇠퇴에 함께 관심을 끌지 못한 주제도 있었다. 책임보험의 논문이 31%, 자동차보험논문이 25%에 이르는 것에서 산업화에 따르는 보험전공학자의 관심을 엿볼 수 있었다. 지난 50년 간의 보험학회지의 손해보험법편의 논문을 리뷰한 결과 치열한 보험전공학자의 연구가 우리나라 손해보험의 발전의 토대이었음을 확인하였다. 향후에도 보험학회지에서 손해보험법 분야의 풍성한 연구결과를 볼 수 있기를 기대한다.
