이 글은 경찰문화가 경찰활동에 미치는 영향과 이로 인해 파생되는 인권보호와의 상호성과관계를 파악하기 위한 현상학적이자 담론적인연구이다. 경찰권 행사(평등의 원칙, 비례의 원칙, 적합성의 원칙)와 인권보장(자유권과 사회권, 그리고 연대권)은 상호성(Mutuality)을 가지며 더불어 인간다운 삶의 진정한 실현을 위한 시대적인 성찰적 숙고에 대한 결과를 확보하기 위한 가장 중요한 과제이다. 또한 인권과경찰의 대립관계에서 인권과 경찰은 상생이자공존이유임을 확인하고자 하는 것이 본 연구의목적이다. 개인은 자유로워질수록 인권을 스스로 체화하면 그럴수록 사회에 더욱 의존하게된다. 더불어 경찰활동도 이와 동반하여 공동가치와 신념에 의한 통합으로서의 전통사회의특징을 기계적 연대로 표현하고 상호의존성을통한 통합으로 발전된 사회의 기초를 유기적연대로 지칭하면서 유기적 연대가 기계적 연대보다 더 강하며 도덕적으로도 우위에 있다고할수있다. 정치문화의 하위문화인 경찰조직문화에 의존하는 경찰활동은 조직문화와 상부의 지시가 아닌 실정법과 원칙에 입각해야 한다. 한국에서제도와 기구는 정치이데올로기와 기득권집단의이해관계에 의존하기에 그 목적성과 목표가 불일치가 태반이다. 각 개별기구들의 자치성은곧 여타 다른 기구와의 조화이다. 다원적이고복합적인 사회의 구성원리를 상호작용성을 승인하고 동의하는 가운데 법과 제도는 인간을위한 인간에 의한 실천이 가능해진다고 할 수있다. 그 실정법은 구성원들의 합의에 의한 산물이여야 하며 원칙은 누구나가 동의할 수 있는조화의교점이여야 한다. 정치문화를 매개로 조직 내부의 능률성과 효과성을 추구하는 경찰문화는 오늘날 한국사회를 관통하는 인권중심과 소통과 공존중심의 사회구성원리와는 적합지 않다. 필자는 경찰조직문화는 인권보호와 그 연관성을 시민참여형 거버넌스와 분권화를 통한 조직문화의 개선이 최선임을밝히고자한다.

This article is policing the police and the effects of culture-derivedBecause of this relationship between human rights and protection andmutual interest for understanding the phenomenological study ofdiscourse. Exerting police power and human rights is reciprocity(Mutuality) in addition to having a real life for the realization of thehuman era for popular reflexive deliberation results the most importantchallenge is to secure. In addition, in relation to human rights andpolice confrontation and mutual co-existence of human rights and thepolice have to ask why it is that is the purpose of this study. Korea political culture is an authoritarian to create the most lethallimit is a factor, but did Confucianism, Confucianism after the collapseof the system, to form a new consciousness or value system. Spread itdoes not matter. Political culture that is present in the sub-culture ofthe police culture by analyzing why and what makes democracy workauthoritative and whether the police activity is limited to the protectionof human rights should reveal character. Human rights and freedom ofindividuals included the embodied self is more dependent ongeureolsurok society. In addition to police activity, accompanied by theshared values and beliefs as an integrated feature of traditional societyand the interdependence of mechanical solidarity expressed through the integration of advanced society is referred to as the basis for organicsolidarity and organic solidarity is stronger than the mechanical agethat moral superiority can be also. Mediated political culture within the organization to pursue efficiencyand effectiveness of the police culture of human rights through thecommunity center in Korea today and coexistence and communicationwith the central organizing principle of society. I have the policeorganizational culture and its relationship to the protection of humanrights and decentralized governance through citizen participation toimprove the organizational culture to reveal who the best.
