This article examines descriptively “the Insolvency Exclusion Clause(4.6)” which stipulates Insurer’s Exclusion Perils among 19 Clauses in the revised 2009 ICC. The credit crunch and assorted financial crises have placed a greater number of shipping companies at risk of insolvency in recent years. Unlike the 1982 version, the 2009 ICC insolvency exclusion clause only operates to preclude indemnity if the assured is privy to at or before the time of loading of cargo. Moreover, the exclusion will not apply when insurance has been assigned to a third party in good faith. And the exclusion protests the innocent assured or assignee in the event of financial default bringing the voyage to an end. This clause is considered more favorable to the Insured. Therefore, these the insolvency or financial default of shipping companies does not happen, importer and exporters must choose a shipping company whose credit reputation is excellent.
