A local government can exercise its self-governing right within its determined boundaries. They are called the boundaries of a local government. As a local government is closely linked with neighboring ones, the boundaries among them should be clearly determined so that each of the neighboring local governments can exercise its individual power. Article 4 of the Local Autonomy Act provides that the jurisdictions of local governments shall in principle be the same as prescribed by the previous provisions of the Act. As this provision has been in existence since 1949 when the Act was enacted, the jurisdictional areas of local governments remain almost the same as the administrative districts at the time of Korea's liberation from Japanese colonial rule. As to the issue of which local government shall have jurisdiction over the land to be newly formed by the Saemangeum land reclamation project, each of the neighboring local governments has tremendous interests. It is because the jurisdictional area of a local government is a constituting element of the local government, along with its residents and self-governing right. However, a lot of disputes have occurred with regard to jurisdiction over the land which has been newly formed by a reclamation project, due to unclear criteria for determining the boundaries of a local government. This study has introduced judicial precedents and theories relative to this issue. Especially, this study has analyzed the meanings and implications of the Supreme Court's decision issued last November. The Supreme Court's decision as to the jurisdictional authority of a local government over the embankments has comprehensively taken into account the topography at the time of completion of the whole Saemangeum Project, the effectiveness of national land management, the conveniences of residents, etc. Since each of the areas A, B, and C referred to in the decision is considered to be the extension of the boundary of each existing local government, they shall be subject to the jurisdiction of the closest existing local government. From this premise that each of the areas A, B and C belongs to each different local government, the boundaries of competent local governments with regard to the embankment sections shall be determined in correspondence with the management of the land to be newly formed. In other words, determination of jurisdiction over the embankment areas shall be made taking into consideration not only the current state but also the whole picture of the Saemangeum Project to be completed afterwards.

지방자치단체는 정해진 지역 내에서 자치권을 행사할 수 있다. 이를 지방자치단체 구역이라 한다. 지방자치단체는 다른 지방자치단체와 연접해 있는 관계로 서로의 권한이 분명하게 확정되려면 구역의 경계가 분명하게 나누어져 있어야 한다. 지방자치법 제4조는 지방자치단체의 구역을 종전의 예에 의하도록 규정하고 있다. 이 규정은 지방자치법이 제정되었던 1949년부터 존재하였으므로 지방자치단체의 구역은 해방 전의 행정구역이 대체로 그대로 이어져 내려오고 있다. 새만금 간척사업에 의해 조성되는 신규 토지를 어느 지방자치단체의 구역으로 할 것인지 각 지방자치단체는 첨예한 이해관계를 가진다. 지방자치단체는 주민과 자치권과 함께 구역이 그 존립의 3요소를 이루기 때문이다. 그런데 그간 간척 사업으로 새로 생겨난 토지에 대해서 지방자치단체의 구역을 결정하는 즉, 관할권을 획정하는 기준이 명확하지 않아서 다툼이 많이 존재하였다. 이 글에서 이 문제에 대하여 그간의 판례와 학설을 소개하였다. 특히 지난 11월에 내려진 대법원의 판결을 중심으로 이 판결이 가지는 의미와 시사점을 분석하였다. 대법원의 방조제에 관한 귀속 지방자치단체의 결정은 새만금사업 전체의 개발계획을 고려하여, 사업이 완성되었을 때의 지형이나 국토관리의 효율성과 주민편의 등을 종합적으로 판단하고 있다. 대법원이 설시하고 있는 A, B 그리고 C의 각 지역은 기존 각 지방자치단체의 구역의 연장이라고 볼 수 있으므로 연접한 지방자치단체에 귀속시킴이 타당할 것이다. 이를 기초로 하여 본다면 즉, A, B 그리고 C 구역이 각 지방자치단체에 귀속됨을 전제로 하여 판단하면, 방조제 구간의 귀속 지방자치단체 구역 결정은 신규 조성되는 토지의 관할에 상응하여 이루어져야 한다. 다시 말하면 방조제 구역 귀속결정은 현재의 상황과 함께 향후 조성되는 새만금 사업의 전체 구도를 염두에 두고 이루어져야 한다.
