This work is to trace the efficacy of Islam in Malaysian legal system in perspective of legal history. In particular, it attempts to debunk the dichotomy of tradition and modernity that is a broadly envisioned assumption. For the aim, in the first place, this study examines Islamic influence on Malay legal system before British colonial rule. On the eve of the colonial rule, Islamic law became a general law in Malay Peninsula. Secondly, it surveys the introduction of British Common Law and its impact on Malay Islamic law under the colonial rule. During the period, Islamic law turned into a personal law, while British Common Law became a general law in the Peninsula. Finally, this paper examines Islam and Malay legal system after independence in 1957, focusing on the impact of Islamic revivalism on the legal system. Based upon these examinations, this study makes a conclusion that tradition is a resource now capable of being consciously used to fashion and legitimate a form of life rather than the residue of the past.
