There is the business value of greater visibility in the invisible world of Ubiquitous IT. It can exchange any and various informations, whenever, wherever and with whomever people want, transcending the barriers of time and space. This modern phenomenon is able to explained in slightly different perspective arising from the Ubiquitous IT connected with its network; network expansion has seen a shift from networks that are fixed and closed to more flexible, mobile networks, and we are now seeing the advent of an unfettered, ubiquitous network. This means that the range of visibility is expanding. With the ease assessing of the business value of visibility on the basis of Ubiquitous IT, the fixed and closed networks in the past is readily apparent. Also, the numerous important Factors in this visible zone provided by mobile networks could also become quite clear technical Advances and huge fear in our daily life which would not be ever experienced; the pursuit of well-being or LOHAS due to increased income and more ego-centric attitudes have brought about new advantages in life style. But the other side, an increase in subterranean tension about weather disasters, crime, terrorist attacks has caused the IT network to great danger in security which has concern in our existence. Ubiquitous IT(u-IT) is characterized by terms 'real', 'connected', 'invisible' and 'calm'. u-IT enabled all objects to have computing power and allows their use anytime and anywhere through networking. Therefore, this kind of the intelligent system, u-IT is able to afford more convenient and safe living conditions. However in the same breath, it would occur lots of high tech Accidents where most of culture and civilization in the modern society would be apt to be seriously destroyed. The goal of this paper is to study on the Class Action and Verbansklage to claim damages of life or property arising from negative effects related with unstable and technical Ubiquitous IT which would go out of intentional and conscious scientific control.
