With the development of Internet and Web environment, the users have increasingly used contents in various ways. For example, Web 2.0 applications such as blogs,podcasts, wiki, or video sharing, enable users easily to create and share text, videos or pictures, and to play a more active and collaborative role in content creation and knowledge dissemination. From the viewpoint of copyright law, the use of the pre-existing works for the UCC is currently very controversial because it is very easy to infringe copyright. The Korean Copyright Act does not currently contain an exception which would allow the use of pre-existing copyright protected content for creating new or derivative works. Therefore, court tries to interpret the act as 'quotation'. In the light of the intent of legislation of the 'quotation' provision, it will be difficult to extend the scope of its interpretation unlimitedly. Accordingly, it is desirable to introduce 'fair use' doctrine as a general provision that will be able to become a flexible criteria for the interpretation of UCC. However, if fair use doctrine is introduced only for the purpose of the defense at court, not for the purpose of request of resumption of the reproduction and interactive transmission of UCC to the OSP, the meaning of its introduction will be decreased. In this regard, the 'Sondambi' case is very suggestive. The Appellate court made an efforts to rule reasonably the case without tying up to the literary interpretation. However, it would be much more economic and efficient that users can request the resumption to the OSP directly without going to the court, like in the USA. On the consideration of this, this article suggests the amendment of Korean Copyright Act in order to adopt 'counter-notification' provision of DMCA which a user can request the resumption to the OSP directly if the user's act is fair use.

인터넷이 발달하고 웹환경이 변화함에 따라 유저(user)들의 이용형태도 다양해졌다. 예컨대 인터넷이 발달한 초기에는 기존의 저작물을 그대로 이용하는 소위 '재현적 이용(dead copy)'이 주를 이루었다면, 최근 몇 년 동안에는 유저가 기존의 저작물을 이용하여제작하거나 스스로 만든 콘텐츠를 다른 유저들과 함께 공유하려는 현상이 뚜렷해졌는데,UCC가 그 대표적 예이다. 현재 문제가 되고 있는 UCC제작을 위한 기존 저작물(원저작물)의 이용행위는 단순한 재현적 이용의 범위를 넘는 것이므로, 자칫 저작권침해를 구성하기 쉽다. 우리 저작권법은 이를 저작권 제한사유로 명시하고 있지 않기 때문에 판례는이 문제를 ‘인용’규정으로써 해결하려는 경향이다. 그러나 인용의 입법취지에 비추어보면이를 무한정 확대해석하기는 어려울 것이므로 공정이용과 같은 일반조항의 도입이 다양한 UCC 제작에 대한 유연한 해석기준으로서 바람직하다고 생각한다. 그러나 공정이용과 같은 일반조항이 도입된다 하더라도 그와 같은 조항이 소송에서의항변사유에만 머무르고, 삭제된 UCC의 복제․전송의 재개를 OSP에게 요구할 수 있는‘소명요건’으로 연결될 수 없다면 UCC제작의 장려라는 측면에서는 공정이용도입은 그의미가 크게 축소될 것이다. 손담비의 ‘미쳤어’사건은 이와 같은 점에서 시사하는 바가 크다. 이 사건에서 우리 항소심 법원은 현행 법조문의 문리적인 해석에 구애받지 않고UCC의 저작권침해판단에 있어서 합리적인 해석론을 전개하고자 하였다. 그러나 미국저작권법(DMCA)의 UCC 삭제통지 및 대응통지의 요건과 같이 소송을 거치지 않고 유저들이 소명으로 자신의 UCC 재개를 요구하여 해결할 수 있다면 보다 경제적이고 바람직한 방법이 될 것이다. 이와 같은 점을 고려하여 본고는 우리 저작권법의 소명요건에 관한규정을 DMCA와 같은 취지로 개정할 것을 제안한다.
