Nuclear liability and compensation arrangements are effective in internalizing the external costs of nuclear accidents. This study examines the financial cap on nuclear operator"s liability. Beyond this limit states have a legal responsibility for the damage caused by nuclear accidents under their jurisdiction. Nuclear operators benefit from these liability limits and thus they can be regarded as a nuclear subsidy. Nuclear subsidies, through limiting operator"s liability, result in negative policy outcomes such as moral hazards with regard to operators and the exaggeration of the competitiveness of nuclear power. In particular, this paper reviews the competitiveness of nuclear power by examining the external costs of nuclear accidents and nuclear subsidy issues.
