‘Electronic Signature Law of the People"s Republic of China’(hereinafter ‘ESLPRC’) is enacted in order to standardize acts of electronic signature, validate the legal effect of electronic signature, and safeguard the lawful rights and interests of the parties concerned based on data message. For the purposes of this law, electronic signature means the data in electronic form contained and attached to a data message to be used for identifying the identity of the signatory and for showing that the signatory recognizes what is in the message. In the other hand, the data message as mentioned in this law means the information generated, dispatched, received or stored by electronic, optical, magnetic or similar means. Regarding to the data message, this law is make up for the ‘Contract Law of the People"s Republic of China’(hereinafter ‘CLPRC’). CLPRC is formulated in order to protect the lawful rights and interests of contract parties, to safeguard social and economic order, and to promote socialist modernization. Under the CLPRC, a writing means a memorandum of contract, letter or electronic message, including telegram, telex, facsimile, electronic data exchange and electronic mail, etc. which is capable of expressing its contents in a tangible form. Generally, data message means information generated, sent, received or stored by electronic, optical or similar means including, but not limited to, electronic data interchange, electronic mail, telegram, telex or telecopy; and electronic signature means data in electronic form in, affixed to, or logically associated with, a data message, and that may be used to identify the signer of the data message and indicate the signer"s approval of the information contained in the data message. Finally CLPRC and ESLPRC are included this view points.
