Korea’s urban renewal projects by means of a disposal plan have a structure in which a landowner of a previous project site establishes a union satisfying certain conditions for private benefit and invests his or her own assets in kind and participates in the project as a project developer. It makes the project look like a public business, but in fact it is private benefit oriented. Since the project has to bring both direct benefit, which is to maximize private gain, and indirect benefit, which is to bring public benefit, the logic of loss compensation has been applied to the urban renewal projector smooth progress.
In order to effectively respond to structural changes of our society, foundational reinterpretation of the current structure of urban renewal projects is necessary. Private characteristics of renewal projects should be differentiated from government’s role, which meets public needs such as guaranteeing residential life and restoring urban functions by distinguishing the cause of renewal projects to meet public needs from the motivation of renewal projects. In addition, ways of cost sharing of renewal projects should also be modified by differentiating public needs from providing more stable circumstances for the socially disadvantaged. Concerns for the socially disadvantaged, based on the right to live, is related to human basic rights. That is, it is a responsibility of the society and the government. Therefore, the unstable status of shop tenants should be seen as caused by renewal projects to meet public needs to provide residential life and to restore urban functions. It means improving the quality of tenant’s life should be regarded as a matter of the government’s responsibility, separate from renewal projects.
