The purpose of this article is to consider three issues that be related to the interpretation of “democratization of eccnomy” in constituticnal law. first of all, it matters of the relationship between Article 119, section 1 and section 2. The later is interpreted as the exception to the former in general. But the constitutional law did not provide enough information to the ordering. This argument has produced logical contradictions.
Second, it matters of the relationship between the political democracy and economic one. The dichotomy between the state and the economy keeps politic and economy separate. Such a dichotomy of view is just a specific hypothesis for classical economists, and cannot be a argument for the constitution.
Third, it matters of the concept of “democratization of economy”. It usually means the control of market md the participation in economic decision-makings. Constiutional revisions do not say definitely “empty concept” or economic justice about that. Therefore it cannot be said that the co-determination should be denied in constitutional interpretations.
