The purpose of this work aims to analyse the fundamental issues of principles of common benefit under YAR 2004. The tradition of English law is that general average is concerned with the common safety, i.e., preservation of the property involved in the common adventure. However, Continental legal systems have focused on a commercial concern-the safe prosecution of the adventure, which has been and may therefore, if somewhat vaguely, be referred to as the common benefit The Continental conception of the common adventure favours the shipowner by bringing within general average expenses for continuing the adventure which he would normally have to bear himself under English law, but is not inherently defective for that reason. The extended idea of common benefit is a factor which has become a concern of English practice by its influence on the internationally based Y AR. However, the difference between the common law and the Y AR should be exaggerated: repairs to enable further prosecution of the adventure have traditionally been included within general average by English law so long as they are properly treated as losses consequent upon a general average act; and most port of refuge allowances under art XI of the Y AR arise only after a ship has entered a port of refuge for the common safety under art.X(a).
