The breach of country of origin labeling(COOL) as the one of the unfair trade is a kind of criminal, because it can infringe of consumer's right, damage to domestic industries, and deteriorate image of Korean products. The types of the breach of COOL are false pretenses, misconception indication, spoil, modification and omission of origin mark.
We can estimate the rate of the breach of COOL in Korea is about 2.9133% and the volume is about 13,950 billion korean wont US$12,681million). However the rate and amount are very small one compare to sense of public, it is very difficult to exactly calculate them.
We propose some plans to improve the problems on the breach of COOL as follows; First, the government need to supplement on the laws of the breach of COOL. The object of COOL can be added for protecting of manufacturer and domestic industries. Second, the control system of the breach of COOL and the ceiling of penalty provisions somewhat need to strict. Third, one hand, government have to operate strictly to the large scale of criminal of COOL, the other hand, government have to plan to support the small and medium size enterprises from the damage of the breach of COOL. Fourth, It is basically important for public to campaign about the necessity of keep COOL. It is also necessity to open the name of the breach of COOL, if needed.
