It is difficult, as a general rule, for the Korea Export Insurance Corporation to expect profitability from policy insurance. However, if arbitration, the most stable method for dispute resolution, is utilized in international transactions, the rate of return will increase greatly. With export insurance, unlike regular insurance, most 'commercial transaction contracts' are concluded between exporters and importers.
As such, arbitration clauses can be inserted into export contracts, allowing arbitration to be used as a dispute resolution device for not only disputes related to insurance payment but also for disputes related to insurer subrogation between the insurer and insurance policy holder.
Therefore, with the aid of the export insurance corporation and the arbitration board, the following are required for an arbitration activation plan for export insurance: the revision of business agreements according to changes in the trade environment; the provision of arbitration expenses and incentives from the arbitration board; the provision of incentives from the export arbitration insurance corporation for the insertion of arbitration clauses; the improvement of arbitration clause insertion in export insurance contracts; and the betterment of service from the arbitration board concerning the international arbitration system.
