There are many reasons that transparency is emphasized in the Government Procurement, but they can be summarized into four points. 1) Enhancing economic efficiency, 2) Achieving Anti-corruption, 3) Protecting the contractor, and 4) Enhancing accessibility to market (Non-Discrimination). They can also be understood as four major goals of transparency in Government Procurement Contract. Among these points, enhancing accessibility to market is gaining more importance recently under the WTO government procurement regime.
When analyzing the Government Procurement in light of transparency, four aspects need to be considered: 1) Information disclosure, 2) Limitation on Discretion, 3) Provisions on verification and enforcement, and 4) Extent of application of the rules concerning transparency.
When looking at these four aspects in other developed countries or WTO, it is commendable that enhancement of accessibility to market strengthens transparency in collaboration with three other goals. However, too much emphasis on enhancing accessibility to market can end up protecting the "contracter" only. Hence, it is important to find an equilibrium between public agencies and the contractor.
In this respect, each goal of transparency needs to be analyzed separately. Firstly, concerning the economic efficiency, the extent of information disclosure should be determined considering the balance between the public agencies' efficiency and that of the contractor.
Secondly, in regard to the anti-corruption, it is crucial to strengthen judicial review to control the discretionary power to prevent corruption of public agencies. Meanwhile, penal sanction and debarring should be actively implemented to curb corruption of contractor.
Thirdly, concerning the protection of contractor, it is very important to put review system in place. To this end, more conflicts that arise from the government procurement contract should be subject to administrative litigation, and more provisions should be interpreted as imperative.
In regard to the non-discrimination, the distinction between the international bidding and internal bidding should be abolished gradually. However, the discretionary power of public agencies should have more room for internal bidding.
