Professionals take the responsibility for increasing amounts of damages for failure to exercise reasonable care with much greater frequency. In recent years, medical malpractice claims have increased rapidly. This development are a product of the growing in recognition of their rights and capabilities of seeking reimbursement for elements of health care by patients.
In many countries medical malpractice is indeed a significant problem. In recent years, malpractice claims have increased so rapidly and the judgements have increased so markedly that insurers are reluctant to carry these risks.
We have no enough experience about medical malpractice insurance. So we need much information about medical malpractice insurance of foreign countries. Therefore, this article is intended to introduce mainly medical malpractice insurance of Japan.
Certainly medical malpractice insurance is so difficult to operate. Insurers are reluctant to insure medical malpractice insurance with afraid of much losses. Therefore, in order to establish medical malpractice insurance in Korea, we need various plans for introduction; co-operation with medical mutual benefit association, joint-undertaking among insurance companies, group contracts, coercive subscription, the limit of insurance money or exemption money, fair and fast medical review panel and arbitration panels. We need much study about the medical malpractice insurance of other country and other professional liability insurances. Finally, it is essential to combine and hannonize academic researches and actual affairs in insurance industry.
