This paper seeks to suggest some basic ideas of the law of biotechnology, It firstly analyzes existing philosophical and sociological theories of biotechnology, and then explores Jurgen Habermas discourse theory. Recently, biotechnology no longer remains as a sphere of bio-culture. As biotechnology turns into a 'tool' for human beings, the life-world of bio-culture is being replaced by the objective world. This phenomenon can be called 'the colonialization of bio-culture', which refers to the theory of Jurgen Habermas. Existing theories of the permission limit of biotechnology can be classified into ethicism, scientism, normism, and utilitarianism. All of them, however, fail to solve the problems arising between law and biotechnology, The law of biotechnology can be justified when it institutionalizes public opinions and systemizes biotechnology through' bio technological discourses'. Therefore, this article articulates the ideas upon which the law of biotechnology has to be based as follows: Firstly, the communicative community, which decides the permission limit of biotechnology(communicative personality), is required. Secondly, the general standard of behavior is to be taken as the norm which is reproduced ceaselessly by the discursive method(behaviour norm constituted inter-subjectively). Thirdly, a bio-culture must be developed so that all members of the community discursively participate in it in interpreting the meaning of biotechnology(discursive bio-culture).
